Terms and Conditions

Here are the terms and conditions that apply to users of this website who place orders with us. As a company we try to be open, honest and straightforward in all our dealings, especially with our customers. The reasons are that it's easier to work like that, it builds up a good reputation and helps us to be successful. We try to protect our customers from shoddy goods and from poor standards of service. We strive to be helpful and want you to be pleased with us and most of our customers are, thankfully. However, there are times when things go wrong, even though we do our best to solve issues quickly. Also, there are those out there who don't want to think or work as we do and so we have to protect ourselves from them. The following is our way of saying for what we take responsibility and what we will do if things go wrong. If you are unhappy with us then let us know using the contact details on the main website and we will do our best to resolve any issues. If you do place an order with us, using this website then the following conditions will apply to you and us. It's our way to try and keep things clear and to make sure you know what we will and won't do for you.  We know it's dull and boring but it's part of life on the internet. So here goes......

Using this website

By using this website you should know that the following Terms and Conditions apply to you and us (When we say us or we, we really mean Imperial Sports Limited).  We are stating how how we run the website and advise all users of the website to read them. If you buy anything from us, then you will be asked to confirm that you have read and agree with them.  If you don't then please let us know why and will come to some other arrangement, if possible. There maybe times when we need to change something on the site and to these Terms and Conditions, so please do not assume that they will always stay the same.

We will accept payment for orders made using our website by Credit or Debit Card or Paypal. We will also accept cheques or postal orders posted to us.  We understand that not everyone has access to a bank or wants to pay postal order charges and so alternative arrangements can be made. Let us know and we will see what we can do.
 
It is possible to order by post or, in some cases, through your school or college. Different places have different ways of working, so check first to see if you can pay directly to the school or college or university.  Some institutions have order forms for the goods and some of these can be downloaded from our site. If you are unsure then check.

All of the final prices quoted at the checkout stage on this site include VAT. Sometimes VAT is applied to the goods whereas at other times it is not. The decision remains with HM Customs and Excise as to which goods and services are VATable or not. Usually, younger children's clothing and shoes do not carry VAT (they're zero rated (0%)). Which children qualify and which don't is set out in HMRC Reference:Notice 714 (June 2011). However, interpretation of this notice varies between suppliers and so there are differences in which sized goods attract VAT.  if you want to get really confused and have a headache then go see. If you make any sense of it then please let us know.

Delivery charges are also shown and these vary depending on the number of items and location. We do our best to make these free of charge as sometimes the costs to us are minimal and we can pass these savings on. At other times we have to pay for the carriage of the goods and so these charges have to be passed on.  Generally speaking, we deliver the goods to your school or college which saves time and money.
 
We shall not process any orders until we have received the money from you. Most goods we supply have a logo on them and then garment or product is often useless if we cannot take it back into stock. We do not carry large stocks of goods which carry a logo on them because this would be very expensive which means that we would have to charge more for the goods. It is therefore very important that you order the goods that you want with the correct colour and sizing because we cannot accept responsibility for any orders that are incorrectly ordered.  We will do our best to help you if you make a mistake. If you do not send the correct amount for the order then we may return this payment to you.

When we show you our products on this site, we are inviting you to accept our offers and not offer to sell at the price quoted.  We have to say this because if we make a mistake like offering a blazer for £0.00 then some people could demand they had a legal right to buy at that price simply because we were offering it when common sense says that we had just made a honest error. Unfortunately the law disagrees and some people are out for everything they can get. This is why we make this very important distinction to help protect us from such unethical behaviour and legal loopholes. If we do make an error in displaying the price then we will ask you for the difference and if you disagree then we will cancel your order and make a refund. If we over charge you, again by mistake, we will refund you.

We only intend this part of the website online shopping to be used by people who are resident in the UK. We are sorry, but we cannot be held accountable for laws and regulations that are outside the jurisdiction of the UK.  If you want to order goods in another currency then contact us by email and we will make the necessary arrangements.

When you use our debit/ credit card payment system then you might be asked for your password. This is nothing to do with us. It will be your bank, building society or other payment handler wanting to confirm the payment and check you are the card-holder.

Our payment transaction service is secure and uses an encryption technology to make sure that you are fully protected.  We will never, ever pass your information on to anyone else.



LIMITATION OF LIABILTY

The following sections are here so that users of this site can understand our declared legal position in terms of the contract we have with you.  Some of the language isn't easy to understand because it uses legal terms. Sorry about that but it is designed to protect us both if things go wrong.  Here goes....

In respect of any cause of action arising out of or in connection with any purchase made from the website including any action for negligence, our liability shall be limited, to the extent that the cause of action relates to the items purchased on our website to:

    Repairing or supplying the Goods again or refunding the amount paid by you in respect of the Goods purchased.
    Our aggregate liability in respect of all causes of action arising out of or in connection with, the Goods purchased on our website or in connection with your use of the website (whether for breach of contract, in negligence or any other tort, under statute or otherwise at all), including for the loss or damage to Goods whilst in transit, will not exceed an amount equal to the value of the Goods delivered to you under these Terms and Conditions.
    Save in respect of death and personal injury we shall not be liable (whether in contract, tort (including negligence) or otherwise) for any claim arising under or in connection with Goods purchased from the website or your use of the website unless you give us written notice of the claim within three months of becoming aware of the circumstances giving rise to the claim or, if earlier, three months from the time you ought reasonably to have become aware of such circumstances.

LAW AND JURISDICTION
These Terms and Conditions will be governed by and construed in accordance with the laws of England and Wales. Disputes arising in relation to this website shall be subject to the exclusive jurisdiction of the courts of England and Wales. Certain provisions contained in these Terms and Conditions may be disallowed by the laws of the country from which you are accessing the website. If any provision of these Terms and Conditions are found to be invalid or unenforceable by a court, it will be severed from the rest of these Terms and Conditions which shall remain unaffected. A person who is not a party to this contract is not entitled to enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.

ENTIRE AGREEMENT
These Terms and Conditions represent the entire understanding relating to the use of the website and supersede all other statements, representations or warranties (whether written, made by email or oral) made by Imperial Sports Limited. Nothing in these Terms and Conditions shall affect the liability of either party in respect of any misrepresentation, warranty or condition that it makes fraudulently. Any rights not expressly granted in these Terms and Conditions are reserved by Imperial Sports Limited.

FORCE MAJEURE
We shall not be liable to you for any delay in, or failure of, performance of our obligations under these Terms and Conditions arising from any cause beyond our reasonable control including any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion, failure in information technology or telecommunications services, failure of a third party (including failure to supply data) and industrial action.

DISCLAMER OF CONTENT

Whilst we have taken all reasonable steps to ensure the accuracy and completeness of the information on this website it is provided on an "as is" basis and we give no warranty and make no representation regarding the accuracy or completeness of the content of this website. Further, no warranty is given that the website shall be available on an uninterrupted basis and no liability can be accepted in respect of losses or damages arising out of such unavailability.

Access to and use of this website is at the user's own risk and we do not warrant that the use of this website or any material downloaded from it will not cause damage to any property, including but not limited to loss of data or computer virus infection.
